Welcome to Hzaya. These Terms & Conditions apply when you use our website, place an order, upload a photo, or purchase a personalized storybook or related product from Hzaya.

By placing an order, you agree to these Terms & Conditions.

About Hzaya

Hzaya is a personalized children’s storybook brand based in Kuwait. We create premium personalized books where the child becomes the hero of the story using details provided by the customer, such as the child’s name and photo.

  • ## Adult and guardian responsibility

Orders must be placed by an adult.

By placing an order, you confirm that:

  • You are the child’s parent or legal guardian, or you have permission from the parent or legal guardian.
  • You have the right to upload and use the child’s photo and personalization details.
  • The information you provide is accurate and lawful.

How ordering works

The ordering process may include:

  • Entering the child’s name and personalization details.
  • Uploading the child’s photo.
  • Selecting add-ons, if available.
  • Reviewing the order summary.
  • Confirming the final price, delivery fee, and payment method.
  • Completing payment.
  • Receiving order confirmation and updates.

You are responsible for reviewing all information before submitting the order.

Personalization details

To create the book, we may ask for details such as the child’s name, photo, gender or pronouns, age range, dedication message, language preference, story selection, and delivery information.

You are responsible for checking that all personalization details are correct before submitting the order.

Hzaya is not responsible for mistakes caused by incorrect information submitted by the customer, including:

  • Wrong photo upload.
  • Incorrect delivery address.
  • Incorrect dedication message.
  • Wrong language or story selection.
  • Incomplete or unclear customer notes.

Photo upload rules

When uploading a photo, you agree that:

  • The photo does not violate privacy, intellectual property, or any third-party rights.
  • The photo is clear enough for personalization and printing.
  • The photo does not include inappropriate, offensive, unlawful, or harmful content.

We may reject any photo or content that we believe is unsuitable, unclear, unlawful, or against our brand standards.

Copyright and restricted content

You may not upload or request content that includes:

  • Offensive, hateful, violent, discriminatory, or inappropriate content.
  • Content that violates the privacy or rights of another person.
  • False, misleading, or unlawful content.

Hzaya may refuse or cancel any order that violates these rules.

Prices and payment

All prices are shown in Kuwaiti Dinars unless stated otherwise.

  • The final price may include product price, add-ons, delivery fees, and any applicable charges.
  • Payment must be completed before production begins.
  • We may use third-party payment providers to process payments securely.
  • We reserve the right to cancel or refuse an order if payment fails, fraud is suspected, information is incomplete, or the order violates these Terms.

Electronic invoice

After an order is confirmed, Hzaya may send an electronic invoice or order confirmation using the contact details provided by the customer.

The invoice or confirmation may include:

  • Total price including applicable charges.
  • Delivery date or estimated delivery period.
  • Delivery location.
  • Payment method.
  • Order reference number.

Production process

Because each Hzaya book is personalized, production may begin shortly after payment and order confirmation.

Production includes:

  • Preparing the storybook design.
  • Processing the uploaded photo.
  • Printing, packaging, and preparing the order for delivery.

Once production has started, changes or cancellations may not be possible.

Proofs and previews

If Hzaya provides a preview or proof before printing, you are responsible for reviewing it carefully and approving it within the requested time.

Once you approve the preview, Hzaya is not responsible for errors that were visible in the approved version.

If you do not respond within the requested time, production may continue based on the details submitted in the order.

Delivery

Delivery times are estimates and may vary depending on production volume, location, courier availability, public holidays, weather, or circumstances outside our control.

We will make reasonable efforts to deliver within the estimated timeframe.

You are responsible for providing accurate delivery details and being available to receive the order.

Additional delivery fees may apply if:

  • The recipient is unavailable.
  • The order requires re-delivery.
  • The delivery location is outside the standard delivery area.

Delays

If there is a significant delay, we will try to notify you using the contact details provided.

If the delay makes the product unsuitable for the purpose of the order, please contact us so we can review the situation and offer a suitable solution where possible.

Changes and cancellations

You may request a change or cancellation by contacting us as soon as possible.

  • If production has started, the order cannot usually be changed or cancelled because it is personalized for the child.
  • If the order has already been printed or shipped, cancellation is not possible except where required by law or where the product is defective, damaged, or incorrect due to our error.

Returns and refunds

Because Hzaya books are personalized and made according to customer details, they are generally not eligible for return or refund after production begins unless:

  • The product is defective.
  • We sent the wrong item.
  • The mistake was caused by Hzaya.
  • Applicable law requires otherwise.

Complaints and support

Hzaya aims to handle customer complaints clearly and fairly.

Promotions and offers

From time to time, Hzaya may offer discounts, bundles, gifts, free delivery, or promotional campaigns.

  • Promotions cannot always be combined with other offers.
  • We may amend or end a promotion at any time, provided this does not affect confirmed orders unless required for legal or operational reasons.

Intellectual property

All Hzaya designs, stories, illustrations, layouts, product concepts, website content, brand assets, and related materials belong to Hzaya or its licensors.

You may not copy, reproduce, resell, distribute, modify, or use Hzaya content for commercial purposes without written permission.

The personalized book is sold for personal and family use only.

Customer content license

By uploading a photo or personalization details, you give Hzaya permission to use that content only as needed to create, produce, fulfill, deliver, support, and improve your order.

We do not claim ownership of your child’s photo.

Product appearance

We do our best to show products accurately. However, colors, print finish, size, brightness, and layout may appear slightly different depending on screen settings, printing process, paper, materials, and production requirements.

Small differences that do not affect the main function or quality of the product are not considered defects.

Limitation of liability

To the extent permitted by law, Hzaya is not responsible for indirect, incidental, special, or consequential losses.

Our responsibility for an order is limited to the amount paid for that order, except where the law provides otherwise.

Nothing in these Terms limits your legal rights as a consumer under applicable Kuwaiti law.

Governing law

These Terms & Conditions are governed by the laws of the State of Kuwait.

Any dispute will be handled through the competent authorities and courts in Kuwait, unless otherwise required by applicable law.
